WAIVER AND RELEASE OF LIABILITY AND ASSUMPTION OF RISK

    In consideration of me being allowed to participate in any way in any gym-related activities at M4G CrossFit, 1410 Sadlier Circle West Drive Indianapolis, IN, 46239, I agree to the following:


1)    I understand that dangers may be caused by my own actions, the actions or inactions of others participating in the activities, and the conditions present where the activities are taking place. I understand the nature of M4G CrossFit’s activities and acknowledge my experience and capabilities and believe I am qualified to participate in such activities. I further acknowledge that I am aware that the activities will be conducted in facilities open to the public during the activities. I further agree and warrant that, if at any time, I believe conditions to be unsafe, I will immediately discontinue further participation in the activities.


2)    I fully understand that: (a) M4G CrossFit activities involve risks and dangers of serious bodily injury, including permanent disability, paralysis and death; (b) the risks involved in participating in the activities arise both from the location and nature of the place where the activities take place, as well as my own negligence or the negligence of the “releases” described herein; (c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and responsibility for losses, costs and damages incurred as a result of my participation in the activities.


3)    I hereby release, discharge, covenant not to sue and agree to hold harmless M4G CrossFit, its respective administrators, directors, agents, officers, employees and representatives, and, if applicable, owners and lessors of the premises (each one considered one of the “releases” herein) at which the activities take place from all liability, claims, demands, losses, or damages arising out of, caused by, on account of or alleged to be caused, in whole or in part by the negligence of the “releases” or otherwise, including negligent rescue operations and further agree that if, despite this release, I, or anyone on my behalf makes a claim against any of the “releases” described above.


     4) I fully understand and acknowledge that by participating in M4G CrossFit,  any and all photos taken of me while participating at or in M4G CrossFit related activities can be used for any promotional materials.
 
     5)  If you opt out of utilizing M4G CrossFit childcare but bring children to the facility, you are responsible for them.  They are not allowed on the CrossFit floor at any time or for any purpose.  I hereby release, discharge, covenant not to sue and agree to hold harmless M4G CrossFit, its respective administrators, directors, agents, officers, employees and representatives, and, if applicable, owners and lessors of the premises (each one considered one of the “releases” herein) at which the activities take place from all liability, claims, demands, losses, or damages arising out of, caused by, on account of or alleged to be caused, in whole or in part by the negligence of the “releases” or otherwise, including negligent rescue operations and further agree that if, despite this release, I, or anyone on my behalf makes a claim against any of the “releases” described above.


6) I acknowledge the contagious nature of the COVID 19 virus and respect that the facility adheres to the CDC recommendations.  I further acknowledge that M4G CrossFit has put in place preventative measures to reduce the spread of the COVID 19 virus to the best of their abilities.  I further acknowledge that no guarantee exists whether or not I may contract COVID 19 from the facility.  I understand that the risk of becoming exposed to and/or infected with COVID 19 virus may result from the actions, omissions, or negligence of myself and others, including but not limited to, staff and other clients.  I acknowledge that I increase my risk of exposure to COVID19 by participating in services rendered.  I acknowledge that I must comply with all set procedures to reduce the spread while in attendance.

    

I WILL INDEMNIFY, DEFEND, SAVE AND HOLD HARMLESS EACH OF THE RELEASES FROM ANY LITIGATION, EXPENSES, ATTORNEY FEES, LOSS, LIABILITY, DAMAGE OR COSTS THEY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM.


    I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent permitted by the law and agree that, if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
